1. Scope & Acceptance
These Terms & Conditions govern all services provided by Mandé (operating as a sole proprietorship, India) to any client or prospective client. They apply to all engagements regardless of the channel through which they were initiated — including this website, WhatsApp, email, phone, or in-person communication. By contacting us, requesting a quote, making a payment, or instructing us to begin work, you confirm that you have read and agree to these terms.
2. Our Services
Mandé provides web design, web development, search engine optimisation (SEO), and related digital services to small and medium businesses. Additional services such as social media management, digital advertising, and AI chatbot integration are available on request.
The specific deliverables, timeline, and price for each project are agreed in writing (via WhatsApp, email, or a formal quote) before work begins. Nothing in these terms implies a commitment by Mandé to provide any service until a project has been explicitly agreed and a deposit received.
3. Project Scope & Changes
The scope of each project is defined at the start of the engagement. This includes the number of pages, features, and deliverables agreed. Any additions or significant changes to scope requested after work has commenced may be subject to additional charges, which will be communicated and agreed before the extra work begins.
We rely on you to provide the necessary content (text, images, logo, and other materials) in a timely manner. Delays in providing content may affect the delivery timeline. Mandé is not responsible for delays caused by the client’s failure to provide required materials.
4. Pricing & Payment
All prices are agreed individually for each project and confirmed in writing before work begins. Prices listed on this website are indicative starting points only and do not constitute a binding quote.
Standard payment terms are as follows unless otherwise agreed in writing:
- 50% deposit required before work begins
- 50% balance due upon project completion and before final handoff of files and credentials
- For ongoing maintenance plans, payment is due monthly in advance
All prices are in Indian Rupees (INR) and are exclusive of GST where applicable. Mandé reserves the right to withhold delivery of final files and credentials until full payment has been received.
5. Domain & Hosting
Unless the client has opted for a Managed Plan, domain registration and web hosting are the client’s own responsibility. These costs are not included in the project price and are paid directly by the client to their chosen provider.
Typical annual costs for reference: domain registration approximately ₹800–1,500 per year; web hosting approximately ₹1,500–3,000 per year. These are third-party costs and may vary.
Under a Managed Plan, Mandé will handle domain and hosting on behalf of the client, with these costs included in the monthly fee. The domain will remain registered in the client’s name or transferred to them upon request. Mandé is not liable for any downtime, data loss, or service interruptions caused by third-party hosting providers.
6. Revisions & Approvals
Each project includes two rounds of revisions unless otherwise agreed. A revision round is defined as a consolidated set of feedback provided in a single message or document. Revisions requested piecemeal across multiple messages may be treated as separate rounds.
Once the client has provided written approval of the final deliverable (via WhatsApp, email, or any written channel), the project is considered complete. Additional changes requested after approval will be treated as a new scope and charged accordingly.
7. Ownership & Intellectual Property
Upon receipt of full payment, the client owns all deliverables produced for their project, including the website design, code, and content created by Mandé specifically for that project. All login credentials, files, and documentation will be handed over to the client.
Mandé retains the right to display completed work in its portfolio and use it for promotional purposes (website, social media, case studies) unless the client explicitly requests otherwise in writing before project commencement.
The client is responsible for ensuring that any content, images, or materials they provide to Mandé are legally owned or licensed for use. Mandé is not liable for any intellectual property infringement arising from client-supplied materials.
8. Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the course of a project. Mandé will not share, sell, or disclose any client business information, data, or materials to third parties without the client’s explicit consent, except as required by law or as necessary to deliver the agreed services (e.g. passing a logo to a font service for rendering).
9. Cancellation
Either party may cancel a project before work has begun, with no penalty. If the client cancels after work has commenced:
- The deposit is non-refundable
- Any work completed up to the point of cancellation may be invoiced on a pro-rata basis at the agreed project rate
- Any completed work will be handed over to the client upon receipt of payment for work done
For ongoing maintenance plans, either party may cancel with 30 days’ written notice. No refund is provided for the current billing month.
10. Limitation of Liability
Mandé will deliver services with reasonable skill and care. However, we do not guarantee specific business outcomes such as increased revenue, customer acquisition, search engine rankings, or social media growth. These outcomes depend on many factors outside our control.
To the fullest extent permitted by law, Mandé’s total liability to a client for any claim arising from a project shall not exceed the total fees paid by that client for the project in question. Mandé is not liable for any indirect, consequential, or loss-of-business damages.
11. Disputes
In the event of a dispute, both parties agree to first attempt to resolve the matter amicably through direct communication via WhatsApp or email within 14 days of the issue being raised. If a resolution cannot be reached, disputes shall be subject to the jurisdiction of the courts of Tamil Nadu, India, and governed by the laws of India.
12. Changes to These Terms
Mandé may update these Terms & Conditions from time to time. The latest version will always be published at mande.co.in/terms-conditions. Continued engagement with Mandé after an update constitutes acceptance of the revised terms. For active projects, the terms in place at the time the project was agreed will apply unless both parties consent to updated terms in writing.
